Terms and Conditions

These Terms and Conditions (the "Terms") govern the rights and obligations of the parties in connection with the use of the website flexfare.com and meal services provided by Fit 4u Meal Prep LLC, Company Registration No. 201830610296, with its principal place of business at 2450 San Gabriel Way #303, Corona, CA 92882, United States (the "Provider").

These Terms are intended to comply with applicable federal and state consumer protection laws, including FTC guidelines for online and telephone sales.

1. Introductory provisions

  1. The Provider is a limited liability company that prepares and delivers meals according to customer orders in supported delivery regions.
  2. A customer is a natural person who, through the Website or by telephone, requests or enters into an agreement with the Provider for meal services.
  3. These Terms form an integral part of every order and agreement between the Provider and the Customer.

2. Subject of the agreement

  1. The Provider agrees to deliver meals according to the order; the Customer agrees to pay the agreed price.
  2. Meals are prepared in accordance with applicable federal and state food safety regulations. The Provider is not a healthcare provider and services do not constitute medical care.
  3. Photos of meals are illustrative. Minor variations do not constitute a material defect.

3. Formation of the agreement

  1. The agreement is formed when the Provider confirms the order by telephone.
  2. Before confirmation, the Customer is informed of: menu type, price, delivery date and method, and payment terms.
  3. Submitting a form on the Website does not create a binding order. It is a request for a no-obligation consultation.

4. Price and payment

  1. Pricing in effect on the order date applies and is communicated at confirmation.
  2. Prices are stated in the currency confirmed at order time and include applicable taxes where required.
  3. Payment is due upon delivery, by card or cash to the courier unless otherwise agreed. The Provider does not use automatic subscriptions or recurring charges without express consent.
  4. A receipt or invoice is provided upon delivery or by email.

5. Delivery

  1. Delivery is made at the agreed time to the address provided by the Customer, where the Provider's service area covers that location.
  2. Standard delivery is typically 1–2 business days in well-served urban areas and 2–4 business days elsewhere, depending on region and logistics. Exact timing is confirmed when the order is placed.
  3. If the Customer is unavailable at the agreed address and time, meals may be returned; redelivery may incur a fee.

6. Cancellation and refunds

  1. Because meals are perishable goods, refunds after delivery are generally not available except as described in our Refund and Complaints Policy or as required by law.
  2. The Customer may cancel or modify an order free of charge at least 24 hours before the scheduled delivery, by email or phone.
  3. State-specific cancellation rights may apply; nothing herein limits rights that cannot be waived under applicable law.

7. Complaints

  1. Inspect the shipment upon receipt. Report defects (damaged packaging, incorrect contents, spoilage) immediately to the courier or within 24 hours by phone or email.
  2. Complaints are handled within 30 days. Remedies may include replacement, refund, or credit.

8. Customer responsibilities

  1. Provide accurate contact and delivery information, including allergies or dietary restrictions.
  2. FlexFare meals are part of a regular diet. They are not drugs, medical devices, or dietary supplements intended to treat disease and do not replace medical advice.
  3. Consult a physician for health concerns.

9. Limitation of liability

  1. The Provider is responsible for food safety and quality to the extent required by law.
  2. The Provider does not guarantee outcomes that depend on individual factors (health, lifestyle, adherence to recommendations, physical activity).
  3. Nutritional benefit statements are general information based on publicly available nutrition science.
  4. To the maximum extent permitted by law, the Provider's liability is limited to the amount paid for the affected order, except where prohibited by law.

10. Dispute resolution

We encourage you to contact us first at shawnpreps@gmail.com. You may also file a complaint with the Federal Trade Commission at reportfraud.ftc.gov or your state attorney general's consumer protection office.

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Exclusive venue for disputes lies in Travis County, Texas, except where federal law or your state's consumer protection law requires otherwise.

11. Changes

  1. We may update these Terms. The current version is posted on this page with the effective date.
  2. For orders already confirmed, the Terms in effect at confirmation apply.
  3. If any provision is unenforceable, the remainder stays in effect.
